1. Acceptance of Terms
By downloading, installing, or using JustYap ("the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.
These Terms form a legally binding agreement between you and the developer of JustYap ("we", "us", "our"). We reserve the right to update these Terms at any time. We will notify you of material changes through the App or by email if one is on file. Continued use after changes take effect constitutes acceptance of the revised Terms.
2. Description of the Service
JustYap is a real-time AI-powered speech translation application for Android. It transcribes spoken audio in one language and outputs a spoken translation in another language using third-party AI services.
The Service requires an internet connection for online translation. An offline mode using on-device Android speech and translation capabilities is available but may provide lower quality output.
3. Eligibility
You must be at least 13 years of age (or the minimum age required by applicable law in your country) to use the Service. By using the App, you confirm that you meet this requirement. If you are under 18, you must have the permission of a parent or legal guardian.
4. Account and Device Registration
The App automatically creates an anonymous account tied to your device using a hashed, non-reversible identifier derived from your Android device ID. No email address or personal account creation is required.
You are responsible for maintaining the security of your device. We are not liable for any unauthorized access to your account resulting from device loss, theft, or unauthorized access.
If you transfer your account to another device using the in-app transfer feature, your credit balance transfers with it. We cannot recover credits from a device that has been lost, reset, or replaced without a prior transfer.
5. Free Tier
New accounts receive a limited amount of free translation time each week. The specific amount is displayed within the App and may be adjusted at our discretion with reasonable notice. Free credits reset on a weekly basis and unused free credits do not carry over between weeks.
6. Credits and Purchases
6.1 One-Time Purchases
Credits are sold as one-time purchases — there are no subscriptions. Credits are purchased in packs and are applied to your account balance upon successful payment.
6.2 No Refunds
All credit purchases are final and non-refundable, except as required by applicable law or Google Play Store policies. If you believe a charge was made in error, contact us at the address in Section 14.
6.3 Price Changes
We may change the price of credit packs at any time. Credits you have already purchased will always deliver the amount of translation time shown at the time of your purchase, regardless of any subsequent price or rate changes. Price changes apply only to future purchases.
6.4 Credit Expiration and Service Termination
Credits do not expire during normal operation of the Service.
However, in the event that we decide to permanently discontinue the Service, we will provide at least 12 months' written notice before the effective termination date. Notice will be delivered through the App and, where possible, via any contact information you have provided. At the end of the notice period, any remaining unused credits will be forfeited without compensation.
We encourage you to use your credits within a reasonable time. We are not liable for unused credits that are forfeited upon termination of the Service following the notice period described above.
6.5 Premium Voice Credits
Premium voice credits are consumed at a higher rate than Standard voice credits (as disclosed in the App). Selecting Premium voice will reduce your available translation time proportionally. The effective rate applicable to you is always displayed before purchase.
7. Acceptable Use
You agree not to use the Service to:
- Translate, produce, or distribute content that is unlawful, threatening, harassing, defamatory, obscene, or otherwise objectionable
- Violate any applicable law or regulation, including export control laws
- Infringe upon the intellectual property rights of any third party
- Attempt to reverse engineer, decompile, or extract the source code of the App beyond what is permitted by applicable law
- Use automated means to access or abuse the Service or circumvent any usage limits
- Resell, sublicense, or commercially exploit the Service without our written permission
8. Audio Data and Privacy
8.1 Audio Processing
When using online translation mode, audio captured by your microphone is transmitted to third-party AI services (currently Inworld AI) for transcription and translation. This transmission is necessary for the Service to function.
8.2 Data We Store on Our Servers
We collect and store the following information:
- A hashed device identifier (non-reversible, used for account management)
- Your credit balance and transaction history
- Session metadata (duration, approximate characters processed) for billing and analytics purposes
We do not store the content of your audio recordings, live transcripts, phrasebook entries, or translated conversations on our servers beyond the time needed to process each translation.
8.3 Local Device Data
The App may store saved conversations and phrasebook entries locally on your device so you can review, reuse, replay, or delete them later. Local saved conversation data is not uploaded to JustYap servers. You can delete individual saved conversations or clear saved conversation history from within the App.
8.4 Third-Party Services
The Service relies on third-party providers including Inworld AI (AI processing) and Google Play (payments). Online voice translation requests are processed by Inworld AI. Your use of those services is governed by their respective terms and privacy policies, including Inworld AI's Terms of Service at https://inworld.ai/terms and Privacy Policy at https://www.inworld.ai/privacy. We are not responsible for the data practices of third-party providers.
8.5 Privacy Policy
A full Privacy Policy is available within the App (Settings → Privacy Policy) and online at https://justyap.trenty.org/privacy, and is incorporated into these Terms by reference.
9. Intellectual Property
All content, design, code, trademarks, and branding associated with JustYap are the property of the developer and are protected by applicable intellectual property laws. These Terms do not grant you any rights in our intellectual property.
You retain ownership of any audio you record. By using the Service, you grant us and our AI processing partners a limited, non-exclusive license to process your audio solely for the purpose of providing the translation service.
10. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:
- The Service will be uninterrupted, error-free, or available at all times
- Translations will be accurate, complete, or suitable for any particular purpose
- The Service will meet your specific requirements
AI-generated translations may contain errors. Do not rely on JustYap for any translation where accuracy is critical, including but not limited to medical, legal, safety, or emergency situations.
11. Limitation of Liability
To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Service, even if we have been advised of the possibility of such damages.
Our total liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.
12. Indemnification
You agree to indemnify and hold harmless us and our affiliates, licensors, and service providers from any claims, liabilities, damages, judgments, and costs arising out of your violation of these Terms or your use of the Service.
13. Changes to the Service
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time. Except in the case of full service termination (covered in Section 6.4), we are not liable for any modification, suspension, or discontinuation of the Service.
14. Governing Law and Disputes
These Terms are governed by the laws of the Province of Ontario, Canada. Any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.
If you are a consumer in the European Union, you may also have the right to submit disputes to the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.
